These Terms of Service ("Terms") govern your use of the KörperForce HRV Dashboard, its biofeedback games, and related websites and services (the "Service"), provided by KörperForce Human Performance, LLC ("Company," "we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Not medical advice
The Service is for training, relaxation, education and wellness. It is not a medical device and is not intended to diagnose, treat, cure, monitor or prevent any disease or condition. Readings such as heart rate, heart rate variability (HRV) and skin conductance are estimates from consumer sensors and may be inaccurate. Do not rely on the Service for medical decisions. If you have a heart condition, a pacemaker, are pregnant, or have any health concern, talk to a qualified healthcare professional before using biofeedback or breathing exercises. Stop if you feel dizzy, light-headed or unwell.
2. Use of the Service
- You must be at least 18 years old, or have the consent and supervision of a parent or legal guardian. The Service is not directed to children under 13.
- You agree to use the Service in compliance with all applicable laws and regulations.
- You sign in with your Google account. You are responsible for keeping your account secure and for all activity under your account.
- Some features need specific hardware or browsers (for example, a Lightstone sensor and desktop Chrome or Microsoft Edge). We do not guarantee that the Service works with every device or browser.
3. Clinics, coaches and teams
If you use a Clinic or team plan to record or manage other people's data (your "clients" or "athletes"), you are responsible for:
- getting any consent required by law before recording, storing or sharing their data;
- using the Service in line with the professional, privacy and health-information laws that apply to you. If you are subject to HIPAA or similar laws, you are responsible for making sure your use of the Service meets those requirements;
- who you share data with through the Service's sharing features.
Clinic and team accounts sign our Clinic & Team Agreement in the app before adding clients.
4. Subscriptions and payments
- Paid plans are billed in advance by our payment processor, Stripe, at the price and interval shown at checkout (for example, yearly for Individual, monthly for Clinic). Plans renew automatically until cancelled.
- Clinic plans include 20 seats; additional seats are billed per seat as shown on the Pricing page. Changes to your seat count may be prorated by Stripe.
- You can cancel or change your plan at any time from Settings → Manage subscription. Cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.
- We may change prices with notice; changes apply from your next billing period.
- If a paid plan ends, your account returns to the Free plan. Your existing data is kept, but features and the number of athletes you can add are limited to the Free plan.
5. Your data and content
- You keep ownership of the data and content you add to the Service, including session recordings, notes and athlete records.
- You grant the Company a non-exclusive, royalty-free license to store, process, display and transmit your content solely to operate, maintain and improve the Service for you.
- How we handle personal and health data is described in our Privacy Policy.
6. Intellectual property
- All intellectual property rights in the Service, including software, games, artwork, text and trademarks, are owned by the Company or its licensors.
- You may not copy, modify, reproduce, distribute, reverse engineer, or create derivative works from the Service without our prior written consent.
- Wild Divine, Lightstone, Polar, Kubios and other third-party names are trademarks of their respective owners. KörperForce is not affiliated with or endorsed by them.
7. Acceptable use
You agree not to misuse the Service, including by trying to access other users' data, interfering with its security or operation, uploading malicious code, or using it to harm others.
8. Termination
You may stop using the Service at any time and ask us to delete your account (see the Privacy Policy). We may suspend or terminate access to the Service if you breach these Terms, or for any other reason, with or without notice.
9. Disclaimer and limitation of liability
- The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of readings.
- To the fullest extent permitted by law, the Company is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising out of or relating to your use of the Service.
- To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.
10. Indemnification
You agree to indemnify and hold the Company and its affiliates, officers, agents and employees harmless from any claims, losses, damages, liabilities and expenses arising out of your use of the Service or your breach of these Terms, including claims by clients or athletes whose data you manage.
11. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date, and for material changes we will make reasonable efforts to notify you (for example, by email or in the app). Continuing to use the Service after changes take effect means you accept them.
12. Governing law
These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Colorado, and you consent to their jurisdiction.
